Application for Temporary Certificate of Use and Occupancy

"Large Plan" applications with multi-sheet submittals by a Registered Architect, Structural Engineer, or Civil Engineer will receive a first review within 21 business days (scanning requirements(PDF, 209KB)). Permits exceeding 10 MB must be mailed or submitted via share file or Dropbox link.

Our staff will review your application for accuracy and completeness, calculates the required fees, then email you a link to pay your permit fees. Once payment is received, you'll get a receipt with your permit number, which you should use in all communications about the permit. If revisions are needed, you'll receive a comment letter via email. Resubmittals will follow the same process using the Resubmittal, Deferred Submittal, Revision Application.

Once approved, you'll receive your approved plans and Building Permit Card by email. Print these documents and have them available on-site for inspections. Do not begin your project without them to avoid fines.

Building Inspection Services 

Deferred Submittals

The Building Code requires complete construction documents prior to permit issuance. This form shall be utilized to indicate specific areas that are intended to be submitted for review and approval later than permit application submittal. All deferred submittals must be approved by the Building Official prior to building permit application submittal. Allow five (5) working days for review and approval of the request.

  1.  The applicant requesting to defer submittal items will be charged $48 plus the Building Official’s hourly rate to process the request (Fee Schedule #620).

  2. A building permit application will not be issued prior to approval of a complete project submittal including deferred items.

  3. Deferring required plans/or construction documents may increase overall project plan review cycles and cost to the applicant if the application exceeds (3) plan reviews.

  4. It is the applicant’s responsibility to ensure the submittal items are provided to the City of American Canyon in a timely manner.

Temporary Certificate of Occupancy (TCO)

The building official is authorized to issue a temporary certificate of occupancy before the completion of the entire work covered by the permit, provided that such portion or portions shall be occupied safely. The building official shall set a time period during which the temporary certificate of occupancy is valid.

Conditions of Temporary Certificate of Occupancy: 

  1. The Building Division will provide a thirty-day (30) Temporary Certificate of Occupancy (TCO) to use a portion or portions of a structure prior to the completion of the entire structure if the Chief Building Official Finds that no substantial hazard will result, and the portion or portions comply with the provisions of the California Codes, Building standards, State Laws and Local Ordinances.  Prior to the issuance of a Temporary Certificate of Occupancy (TCO) a $390.00 issuance fee must be paid (this includes one inspection) associated with determining building compliance for temporary occupancy.

  2. Building Division may suspend or revoke the Temporary Certificate of Occupancy (TCO) if it is determined that the building is in violation of any City of American Canyon Municipal Code or Regulations.

  3. Prior to the expiration of the Temporary Certificate of Occupancy (TCO), it is the responsibility of the Owner or Contractor to request required inspections for completion of permitted work.  Acceptable final inspections are required by all applicable trades prior to issuance of a Certificate of Occupancy. If uncompleted work cannot be finished during the duration of the TCO, reapplication for a TCO is required.

  4. The TCO process allow applicants to have temporary occupancy for areas of the building to perform activities such as training of employees, stocking shelves and materials, setting up workstations, etc.  The TCO process is limited to occupancies that do not pertain to dwelling units.
2022 California Building Code Section 111

Certificate of Use and Occupancy (CO)

A certificate of occupancy (CO) certifies the building is ready for occupancy. To receive a certificate of occupancy, the permit should have received final inspections by the Building Division and the Fire District. The certificate of occupancy will be issued when Building Fire, Public Works, and Planning complete their certificate of occupancy inspection and there are no further outstanding corrections required.

Certificate of occupancy will be processed within 48 business hours of submittal of when the application has been processed and accepted for review. 

Applications received after 12:00 p.m. PST will be processed the following business day.  Requests received on a holiday, weekend, or furlough will be processed the next business day.

Per 2022 California Building Code Section 111 Certificate of Occupancy:

(A)111.2  Certificate issued. After the building official inspects the building or structure and does not find violations of the provisions of this code or other laws that are enforced by the department, the building official shall issue a certificate of occupancy.

(A)111.4 Revocation. The building official is authorized to suspend or revoke a certificate of occupancy or completion issued under the provisions of this code in writing, wherever the certificate is issued in error or on the basis of incorrect information supplied, or where it is determined that the building or structure or portion thereof is in violation of the provisions of this code or other ordinance of the jurisdiction.
